Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Nexura, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the service.

These Terms constitute a legally binding agreement between you and Nexflow Tech ("we", "us", "our"). We may update these Terms from time to time. Material changes will be posted on https://nexura.nexflowtech.in/terms with an updated "Last updated" date. Your continued use after changes become effective constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years old to create a Nexura account. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Match (dating/discovery) feature is intended only for users who are at least 18 years old. By enabling Match or submitting dating profile information, you represent that you meet this age requirement.

You may not use the service if you have been previously banned or if your account has been terminated for violation of these Terms.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@nexflowtech.in if you suspect unauthorized access.

• Provide accurate and current registration information.
• Maintain only one personal account unless we authorize otherwise.
• Do not share, sell, or transfer your account to another person.
• You may delete your account at any time from Settings → Delete account in the app.

4. Description of Service

Nexura is a social communication platform that may include, depending on your plan and region:

• End-to-end encrypted one-to-one messaging
• Voice and video calls (WebRTC)
• Social feed, stories, and reels
• Match / dating discovery
• Live and on-demand translation features
• Friend requests, follows, and public profiles
• Optional premium subscriptions and in-app purchases
• Optional advertising on free plans

We may add, modify, or discontinue features at any time. We do not guarantee uninterrupted or error-free service.

5. End-to-End Encryption

One-to-one chat messages are encrypted on your device before transmission using industry-standard encryption (NaCl box / X25519). We store ciphertext on our servers and cannot read the plaintext content of those messages.

Encryption protects message content, not all data. We may still process metadata such as sender and recipient identifiers, timestamps, message type, delivery status, and conversation membership. Translation, moderation reports, and certain media features may involve processing plaintext or decrypted content as described in our Privacy Policy.

You are responsible for safeguarding your device and encryption keys. We cannot recover encrypted message content if you lose access to your device or keys.

6. Acceptable Use & Community Standards

You agree not to use the service to:

• Harass, threaten, defame, bully, or abuse any person
• Post or share illegal content, including child sexual abuse material (CSAM), which we report to authorities
• Impersonate others or misrepresent your identity or age
• Spam, scrape, or use automated systems without our written permission
• Distribute malware, attempt unauthorized access, or disrupt our systems
• Promote violence, hate speech, or discrimination based on protected characteristics
• Share another person's private information without consent (doxxing)
• Use Match or messaging to solicit commercial sex, trafficking, or fraud
• Circumvent security, rate limits, or subscription restrictions

We may investigate reports, remove content, restrict features, or terminate accounts that violate these rules or applicable law.

7. User Content & License

You retain ownership of content you create and share (messages, photos, videos, reels, stories, profile information). By posting content on public or semi-public areas of the service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and improve the service.

You represent that you have all rights necessary to share your content and that it does not infringe third-party intellectual property or privacy rights.

8. Match & Safety

Match suggestions are provided for entertainment and social discovery. We do not conduct criminal background checks and make no guarantees about the identity, intentions, or safety of other users.

• Meet in public places and inform someone you trust when meeting people from the app.
• Never send money or share financial details with people you meet through the app.
• Use in-app block and report tools if someone makes you uncomfortable.
• Match is not available to users under 18.

9. Voice & Video Calls

Calls are transmitted using WebRTC peer-to-peer technology where possible. Call quality depends on your network and device. You must not record calls without the consent of all participants where required by law.

Free and paid plans may include daily call duration limits as described in the app.

10. Translation Features

When you use translation (including camera, voice, or live chat translation), the text or audio you submit is processed by third-party providers such as Google Cloud Translation, Vision, or Speech-to-Text to generate a translation. That processing is not end-to-end encrypted. Use translation only for content you are comfortable sharing with those providers.

11. Subscriptions, Payments & Refunds

Nexura may offer free and paid plans (e.g., Nexura Plus, Nexura Pro). Paid subscriptions may be billed through Apple App Store, Google Play, Razorpay, Stripe, or other authorized payment processors.

• Prices, billing cycles, and features are shown at purchase and may vary by region.
• Subscriptions auto-renew unless cancelled through your app store or account settings before the renewal date.
• Refunds for App Store and Google Play purchases are governed by Apple and Google policies.
• For other payment methods, contact support@nexflowtech.in within 7 days of purchase for billing disputes.
• We may change pricing with reasonable notice; changes apply to subsequent billing periods.

12. Advertising

Free plans may display advertisements served by partners such as Google AdMob. Ad partners may collect device identifiers and usage data subject to their own privacy policies. Paid plans that disable ads will not show in-app advertising placements we control.

13. Intellectual Property

Nexura, our logos, software, and branding are owned by Nexflow Tech or our licensors. These Terms do not grant you any rights to our trademarks or proprietary technology except as needed to use the service.

14. Suspension & Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access immediately if you violate these Terms, create risk for other users, or as required by law.

Upon termination, your right to use the service ends. End-to-end encrypted messages you sent may remain on recipients' devices. Account deletion is described in our Privacy Policy.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE SECURE, UNINTERRUPTED, OR FREE OF ERRORS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXFLOW TECH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) one hundred US dollars (USD $100), except where prohibited by law.

17. Indemnification

You agree to indemnify and hold harmless Nexflow Tech from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms or applicable law.

18. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India for disputes not subject to mandatory consumer arbitration in your country of residence.

Nothing in these Terms limits rights you may have under mandatory consumer protection laws in your jurisdiction.
